The Ministry of Labor – Invalids and Social affairs issued Circular No. 08/2016/TT-BLĐTBXH dated May 15th, 2016 on guidelines for collecting, filing, summarizing, apprising, announcing and assesing data of occupational accidents and technical breakouts because of serious violation of occupational safety and hygiene.

The Circular comes into force from July 1st, 2016. Joint Circular No. 12/2012/TTLT-BLĐTBXH-BYT dated May 21st, 2012 by the Ministry of Labor - Invalids and Social affairs and the Ministry of Health on guidelines for declaring, investigating, summarizing and reporting of occupational accidents shall lose effect on the date that this Circular takes effect.

The Circular applies to employers, administrative authorities, organizations and individuals that collect, file, summarize, announce or assess data of occupational accidents and technical breakouts because of violation of occupational safety and hygiene.

The responsibility of the employers are defined as follows:      

- To organize the collection and filing of information of occupational accidents that occurred at their workshops. Moreover, employers shall maintain a form according to Appendix 1 of the Circular;

- To be responsible for summarizing and reporting the information collected and filed  as per Section 1, 2 and 3, Article 36 of the Law on occupational safety and hygiene and Article 24 of the Decree No. 39/2016/ND-CP; to provide the information upon requests by competent authorities in charge of labor issues.

- To be responsible for assessing and announcing occupational accidents data at their workshops as follows:

  • To assess and announce periodically occupational accidents data to employees at their workshops: 6-month data and 1-year data must be announced by the 10th of July of the year and by the 15th of January of the following year, accordingly;

  • The information announced must be publicly displayed at their workshops (where occupational accidents have occurred) and on their websites (if available).

- To be responsible for: implementing the Circular, applying greater measures for better working conditions and training to heighten workers’ awareness of preventing occupation accidents and technical breakouts because of violation of occupational safety and hygiene.
